Q: If an ex-husband remarries, can new wife's income considered in the calculation of child support?

My ex-husband is remarrying. Once this occurs, would the new wives income be figured into the calculations for a child support mofidication, should I take him back to court? I know he has been lying about his "documented" income and hiding dramactic amounts of "under the table income". If her income in factored in, this would help to raise the child support that is owed to my children. Adding more information.....clarifying....will my ex-husbands, NEW WIFES income be considered in with his income, when calculating support for the children he and I had together...

A: Depends on the state...in Missouri no, it is not calculated. I don't think it should count. Those are not his wife's kids. You should get child support for the lifestyle you had when you were married. When the kids go visit their dad, they can enjoy the new lifestyle. Just because his wife makes money, doesn't entitle someone from his past to get her hands on it. Also, I doubt you really are thinking about what is owed to your children...you are thinking about what is owed to you. If you truly believe this, then when you get remarried, his child support should be reduced.
